1. Introduction and Acceptance of Terms
Welcome to Petals & Pastry. By accessing, browsing, or using our website, ordering any products, or utilizing our services, you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

Contact Email: [hello@petalsandpastry.com]
Service: Online sale and delivery of fresh flowers and custom-baked cakes and desserts (collectively, “Products”).
2. Ordering and Payment
2.1 Order Confirmation
Your placement of an order does not necessarily constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including unavailability of inventory, payment processing issues, or geographical restrictions. A contract for the sale of Products is only formed when we send you an email confirming that your order has been accepted and dispatched.
2.2 Pricing and Payment
All prices are listed in [Your Currency, e.g., USD] and are subject to change without notice. The price displayed at the time of order placement is final for that order. We accept major credit cards and other payment methods as displayed on our checkout page. Payment must be received in full before an order is confirmed and processed.
2.3 Custom Order Lead Times
Custom cakes, tiered cakes, and large floral installations require a minimum lead time of [e.g., 2-3 weeks]. Placing an order request outside this window may result in cancellation or an additional rush fee, subject to our discretion.
3. Delivery and Fulfillment
3.1 Delivery Coverage and Fees
We offer delivery within a specific service area. Delivery fees are calculated at checkout based on the recipient’s postcode. We reserve the right to decline delivery to addresses outside our established delivery zones.
3.2 Same-Day Delivery
Same-Day Delivery is subject to availability of stock and driver capacity. Orders must be placed before [e.g., 12:00 PM local time]. If we cannot fulfill a Same-Day order, we will contact you immediately to reschedule or issue a refund.
3.3 Accuracy of Delivery Address
It is your responsibility to provide a complete and accurate delivery address. Petals & Pastry is not responsible for non-delivery or late delivery resulting from incorrect or incomplete address information provided by the customer.
3.4 Recipient Availability
If the recipient is not available to receive the delivery, we will take reasonable steps to ensure the Product is left safely (e.g., with a neighbor, in a secure porch, or at a front desk). Perishable items (cakes and flowers) cannot be returned to the studio and redelivered the next day. If a safe drop-off is impossible, we will attempt to contact the sender. If we cannot reach the sender, the items will be returned to the studio and may require a new order and delivery fee for re-shipment.
4. Cancellations, Returns, and Refunds
4.1 Perishable Goods Policy
Due to the nature of fresh flowers and baked goods, they are highly perishable. As such, we generally do not accept returns or offer refunds based on a change of mind.
4.2 Order Cancellation
Standard Orders (Non-Custom): Cancellations must be requested at least 48 hours before the scheduled delivery date for a full refund.
Custom Orders: Cancellations must be requested at least 7 days prior to the scheduled delivery date. A non-refundable deposit of [e.g., 25% or $50] may apply to cover initial material costs and consultation time.
4.3 Quality Guarantee and Defects
If you receive a Product that is visibly defective, damaged upon arrival, or incorrect, you must contact us at [hello@petalsandpastry.com] within 4 hours of delivery, providing photographic evidence of the defect. We will review the claim and, at our discretion, offer a replacement or a full or partial refund.
4.4 Flower Substitutions
Due to the seasonal nature of flowers, we reserve the right to substitute blooms of equal or greater value and similar color palette when the specified variety is unavailable, as outlined in our FAQs.
5. Website Use and Intellectual Property
5.1 Content Ownership
All content on this website, including but not limited to designs, text, graphics, logos, product photos, and the arrangement thereof, is the property of Petals & Pastry and is protected by copyright and intellectual property laws. Our total liability to you for any claim arising from an order shall not exceed the total price of that order.
7. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of [Your State/Province and Country, e.g., the State of California, USA]. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in [Your City, State/Province].
8. Changes to the Terms
We reserve the right to update or modify these Terms at any time without prior notice. The Terms in effect at the time of your order will govern that transaction.
